Supply is the provision of goods for use or sale in response to a request or demand for the goods.
In the pharmaceutical, biotech and life sciences sector, and deal making in particular, supply is often the subject of a contractual agreement between two or more parties, where the one party wishes to have a product manufactured and then supplied and the other party is able to manufacture and supply said product.
There are commonly three types of agreement:
- Contract agreement - a stand alone agreement whereby one party seeks supply of a product from another company
- Contract manufacture and supply agreement - a stand alone agreement whereby one party outsources its product requirements to a specialist manufacturing and supply company.
- As part of a wider agreement - supply may form part of a wider agreement, where for example one party is seeking to license in a technology or product from another party, but in order to facilitate the commercialization of the technology/product, the licensor supplies product to the licensee to allow clinical evaluation and/or commercialization.
